Annex I: Prohibited and Restricted Activities

This Annex forms an integral part of Cuanto's Terms and Conditions.

1. Purpose

This Annex lists the products, services and activities that may not be offered through the Platform, and those that require Cuanto's prior authorization.

It applies to all Sellers, regardless of the payment method or the payment service provider through which the transaction is processed.

2. The three states

Unrestricted. The Seller may offer the product or service without any additional step, provided it complies with the law applicable to its activity.

Restricted. The Seller may only offer the product or service by following the review procedure corresponding to its level, in accordance with Section 3. Level 1 activities require a representation and warranty from the Seller; Level 2 activities require Cuanto's prior written authorization, and publishing them without it is treated as a prohibited activity.

Prohibited. The product, service or activity may not be offered under any circumstances. Its detection entitles Cuanto to immediately suspend the Store, withhold any pending sums in accordance with Section 4.5 of the Terms and terminate the Agreement, without any liability.

3. Review procedure for restricted activities

Restricted activities are divided into two levels according to their risk. Section 6 indicates the level of each.

3.1. Level 1 — Representation and warranty

3.1.1. The Seller must declare the category when publishing the product or service. No prior approval from Cuanto is required.

3.1.2. Upon publishing, the Seller represents and warrants that it holds all permits, licenses, registrations, professional qualifications and authorizations required by law for its activity, valid and in its own name, and undertakes to obtain and keep them valid at its own cost and risk throughout the term of the Agreement.

3.1.3. Cuanto may at any time request documentation evidencing the foregoing. The Seller must provide it within the period Cuanto indicates. Failure to provide it entitles Cuanto to suspend the listing and to apply Sections 4.5 and 6.3 of the Terms.

3.1.4. Cuanto assumes no liability whatsoever for the Seller's lack of permits, licenses or authorizations, and the Seller shall hold Cuanto harmless in accordance with Section 10 of the Terms.

3.2. Level 2 — Prior authorization

3.2.1. The Seller must request authorization before publishing the product or service, through the channels Cuanto makes available.

3.2.2. The request must be accompanied by: (i) a description of the products or services; (ii) the licenses, permits, sanitary registrations, professional qualifications or authorizations required by law for that activity, valid and in the Seller's name; and (iii) any additional information Cuanto requires in order to assess the risk.

3.2.3. Cuanto shall assess the request within a reasonable period from receipt of the complete request, and shall communicate its decision to the Seller. Silence does not constitute authorization.

3.2.4. The authorization is specific to the approved products or services, personal and non-transferable, and revocable by Cuanto at any time where the circumstances that gave rise to it change, where the licenses supporting it expire, or where required by law, the card brands, the payment networks or Cuanto's payment service providers.

3.2.5. The Seller must keep valid the licenses and permits that supported the authorization, and must inform Cuanto immediately if any of them expires, is suspended or is revoked.

3.2.6. Publishing a Level 2 activity without prior authorization is treated as a prohibited activity.

4. Jewelry, watches and accessories

A category with graduated treatment by material and by value.

4.1. Unrestricted. Costume jewelry and fashion accessories: pieces made of non-precious metals (steel, brass, copper, aluminum, tin, tungsten, titanium), acrylic, resin, glass, crystal, cubic zirconia, synthetic or imitation stones, imitation pearls, leather, textile, wood or similar materials.

4.2. Restricted. Pieces containing gold, silver, platinum, palladium or other precious metals, or natural precious or semi-precious stones, and watches, with a unit price equal to or greater than USD 500 and less than USD 2,000.

Cuanto may update this Annex where required by applicable law, the card brands, the payment networks or its payment service providers. Updates shall be notified in accordance with the Preamble of the Terms.

Where an update makes prohibited or restricted an activity the Seller was already offering, Cuanto shall grant the Seller a reasonable period to regularize its situation or cease the activity, except where the law, an authority or a payment service provider requires immediate effect.
