At Cuanto we value and respect your privacy. This Privacy Policy describes how we collect, use, share and protect your personal information when you use our services.

Data controller: Cuanto Cuenta Inc., a corporation organized under the laws of the Republic of Panama.

This Policy is governed by Law 81 of March 26, 2019 on Personal Data Protection of the Republic of Panama and its implementing regulations, as well as by any other applicable law.

Capitalized terms not defined here have the meaning given to them in the Terms and Conditions.

1. Information we collect

We collect personal information that you provide directly, such as your name, email address, phone number and payment details. We also collect information automatically through your use of our services, such as usage data, IP address, device type and cookies.

If you are a Seller, we additionally collect the information required to verify your identity and that of your ultimate beneficial owners, your tax and billing details, your bank account information for Settlements, and licensing or permit documentation where your activity requires it.

If you are a Buyer, we collect the information needed to process and deliver your Order, including the delivery address and contact details.

2. Instagram data

If you link an Instagram account to your Cuanto store, we receive your Instagram username, your user ID and your account type. We store this information solely to display a verification badge on your store and to confirm that you own the account. We do not access your posts, followers, messages or any other Instagram data, and we do not post on your behalf.

Deleting your Instagram data: You can disconnect your account at any time from the Cuanto app (Store customization → Instagram → Disconnect), which immediately removes the link to your store. If you revoke access from your Instagram settings (Settings → Apps and websites), Meta notifies us and we delete the data automatically. You may also request deletion by email at support@cuanto.app; we respond to requests within a maximum of 30 days.

4. Who we share your information with

We do not sell your personal information. We share it only in the following cases:

a) Between Buyer and Seller. When you place an Order, we share with the Seller the information needed to process and deliver it, including your name, contact details and delivery address. The Seller may use that information only to fulfill your Order, and is prohibited from transferring it, commercializing it or using it for any other purpose.

b) Payment service providers. We share the information needed to process payments and Settlements with acquirers, payment processors, payment service providers and financial institutions. This includes identification data, transaction information and compliance documentation where those providers require it.

c) Technology and operational service providers that assist us in delivering the service (hosting, communications, analytics, support), under confidentiality obligations.

d) Competent authorities, where required by law, in response to legal process, or in compliance with our anti-money-laundering obligations.

e) To protect rights, our privacy, security or property, and those of our users.

International transfers

Some of our providers, in particular payment service providers and technology infrastructure providers, are located outside the Republic of Panama. By using our services, you accept that your information may be transferred to and processed in other jurisdictions, always subject to contractual confidentiality and security obligations equivalent to those required under Panamanian law.

We retain your personal information while your account is active and for as long as necessary to fulfill the purposes described in this Policy.

Identification, verification and transaction data are retained for a period of five (5) years, counted from the termination of the relationship or from the date of the transaction, as applicable, in compliance with anti-money-laundering and tax regulations. Once that period elapses, the information is deleted or anonymized.

6. Information security

We implement technical and organizational security measures to protect your personal information against unauthorized access, loss or destruction. However, no transmission of data over the Internet is completely secure, and therefore we cannot guarantee the absolute security of your information.

7. Cookies

We use cookies and similar technologies to operate the Platform, remember your preferences, measure usage and improve the service. You can configure your browser to reject cookies, although some features may not work properly.

8. Your rights

You have the right to access, rectify, cancel, object to and port your personal data, in accordance with Law 81 of 2019.

To exercise these rights, write to us at hola@cuanto.app. We will respond within the time frames established by applicable law.

The exercise of these rights does not affect our ability to retain information that we are required to keep by law, as set out in Section 5.

9. Changes to this Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by publishing the new policy on our website and updating the last revised date at the top of this page.
